Shops & Establishments (Kolkata) Online Registration, Renewal, Changes etc.

WEST BENGAL SHOPS & ESTABLISHMENTS ACT, 1963 & WEST BENGAL SHOPS AND ESTABLISHMENTS RULES, 1964

*** The following required supporting documents are to be scanned in PDF format and attached/uploaded to the appropriate place .
  • Documents required for new registration :
    1. One set of appointment letters in Form X, duly received and signed by the employees concerned (to ascertain that all the employees have been given the appointment letters).
    2. The First and the Latest Trade License (to ascertain the exact location, postal address, nature of business, category of the shop/establishment and name of the Proprietor, in case of Proprietorship Concern and the date of commencement of business also).
    3. Voter Identity Card/ Bank Pass Book/ Adhar Card as proof of residential address of shop-keeper/employer/manager and also owners' family members.
    4. Registered/Notarial Partnership Deed, in case of Partnership Concern.
    5. Certificate of Incorporation, Memorandum and Article of Association from Registrar of Companies (R.O.C.), Ministry of Corporate Affairs, in case of Limited / Private Limited Company.
    6. Form 32/ Dir. 12 from Registrar of Companies (R.O.C.), Ministry of Corporate Affairs for appointment of new Directors or changes among the Directors as per attached MOA , in case of Ltd./ Pvt. Ltd. company.
    7. Form 18 from Registrar of Companies (R.O.C.) , Ministry of Corporate Affairs as proof of address of registered office, in case of Limited /Private Limited Company.
    8. A List containing name and residential address of Directors, in case of Limited / Private Limited company, in company letter head.
    9. Certificate of Incorporation and Deed of Partnership, in case of Limited Liability Partners Firm ( LLP ) .
    10. Tenancy Agreement wherever applicable.
    11. RBI Certification in case of Non banking finance institutions .
    12. SEBI Certification in case of establishments dealing with Share or mutual fund.
    13. IRDA Certification_ in case of establishments dealing with Insurance.
    14. Where outsourcing agencies are present in shops/establishments, agreement between the outsourcing agency and shop/establishment should be submitted. The owner of shop/establishment should also submit a declaration regarding the directors list / partners list / owner name with address and the number of employees employed of the outsourcing agency.
  • Documents required for renewal of certificate of registration :
    1. All pages of existing Registration Certificate.
    2. Current valid Trade License (to ascertain that the shop/establishment is currently, in operation).
    3. Employee list as per existing Registration Certificate .
  • Documents required for notice of change :
    For notice of change in case of the employees joining the shop/establishment:
    1. All pages of existing Registration Certificate.
    2. Employee list as on date of application and employee list as per existing Certificate .
    3. One copy of appointment letter in Form X, duly received and signed by the employee concerned.
    For notice of change in case of employees who have left the shop/establishment :
    1. All pages of existing Registration Certificate.
    2. Employee list as per existing Registration Certificate .
    3. Documents regarding payment of Full and final settlement of salary and other dues, if any, of the employee concerned and/or a declaration to this effect.
    For notice of change in case of postal address and location of the shop /establishment :
    1. All pages of existing Registration Certificate.
    2. Current valid Trade License.
    For notice of change in case of Director of Limited /Private Limited Company:
    1. All pages of existing Registration Certificate.
    2. Form 32 / Dir. 12 from Registrar of Companies(R.O.C.) , Ministry of Corporate Affairs.
    3. A fresh list containing name and residential addresses of Directors.
    For notice of change of name, in case of Limited / Private Limited company /LLP Firm :
    1. All pages of existing Registration Certificate.
    2. Fresh Certificate of Incorporation from Registrar of Companies, Ministry of Corporate Affairs/ Partnership Deed.
    3. Current valid Trade License.
    For notice of change of name , address of the Partners and location of shop/establishment, in case of Partnership Concern :
    1. All pages of existing Registration Certificate.
    2. Fresh Partnership Deed.
    3. Fresh Trade Licence .
    N.B : in case of change of all the partners , Certificate to be surrendered to the Registering Authority since the Certificate is non-transferable.
    For notice of change of residential address of shop-keeper/employer/manager:
    1. All pages of existing Registration Certificate.
    2. Voter Identity Card/ Bank Pass Book/ Adhar Card.
    For Duplicate registration certificate due to Loss of registration certificate :
    1. Form F.
    2. Copy of receipt of requisite fees as specified in the rate chart to be made through GRIPS Portal under appropriate head of account.
    3. GDE lodged into the concerned Police Station.
    Notice of winding up :
    1. Form E.
    2. Original Registration Certificate ( there should not be any employee. If there is any employee, online application to be made for notice of change and changed online Registration Certificate to be attached with the Form E).
    3. Renewed Registration Certificate, if renewal is pending as on the date of application for winding up (application for renewal to be made online).
    4. Documents regarding surrender of Trade Licence .
